Please read our terms and conditions before booking accommodation with Breakers North Gold Coast Apartments.

BREAKERS NORTH – TERMS AND CONDITIONS

Your booking with Breakers North is subject to the Terms and Conditions outlined below. It is important that you read and understand these Terms and Conditions prior to booking as they will apply to your stay. By making a booking and paying your deposit, you acknowledge and agree to abide by and comply with these Terms and Conditions as they stand now and at any stage during or after your stay. This section of the website will always display the most up to date version of these conditions. In case of any variation of booking conditions between us and an independent third party booking provider, the terms posted on this website will apply.

1. GENERAL TENANCY RULES:

1.1. Before making a booking & paying a deposit it is your responsibility to have read and understood the Terms and Conditions. We reserve the right to change all or part of these Terms and Conditions at any time and it is your responsibility to keep yourself updated on any changes which will be displayed on this section of our website. 1.2 Guests and invitees must monitor the observance of these Terms and Conditions at all times. A breach by your invitees/guests will be considered a breach by you. A breach of these Terms and Conditions may result in, but is not limited to, you being evicted from the premises, losing your bond (if applicable) and or a deduction made from your credit card, and a forfeit of all monies paid.

2. GUESTS MUST:

2.1 Be a courteous and considerate guest and maintain noise at a reasonable level at all times. 2.2 Observe and abide by any Body Corporate Bylaws at all times. 2.3 Be responsible for their visitors and maintain the security of the premises. 2.4 Abide by any order issued by police or any regulatory authority and refrain from engaging in any illegal, drunken, offensive or obscene behaviour.

3.TARIFFS:

3.1 Prices listed on our website are subject to change, once you have paid your deposit your rate has been locked in. If any specials are held/or lower prices advertised after you have paid your deposit we are unable to amend the rate. 3.2 Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the reservation. Minimum length of stay restrictions may apply to certain rates during special event periods. All prices and other payments and conditions should be confirmed at the time of booking.

4. OTHER FEES:

4.1 Hire items available are at the quoted rate and subject to availability. 4.2 Any lost keys will incur a replacement fee of $130.00. Should this happen during your stay you must advise your reception immediately. 4.3 Additional guest fees are charged at $25.00 per night.

5. DEPOSITS, BONDS & RENTAL PAYMENTS:

5.1 A deposit is required to secure your booking. The amount and when it is due depends on what time of year you have booked.  You will be advised this at the time of booking. 5.2 The balance will also be advised when it is due at the time of booking. 5.3 A $300.00 credit card pre authorisation may be processed on the credit card provided if required. 5.4 If you are not checking in, in person or your check in is outside of business hours ,you will may be asked to provide photo ID (Driver’s License or Passport) and a copy of the Credit Card used to make the booking prior to your arrival.

6. REFUNDS & TERMINATIONS BY GUEST:

6.1 If cancelled more than 14 days before your arrival date, 100% of the deposit will be refunded. 6.2 If cancelled less than 14 days to your arrival date, your deposit will not be refunded. 6.3 Refunds cannot be made for bookings cancelled due to inclement weather or illness. We strongly recommend you take out comprehensive travel insurance. 6.4 All cancellations must be in writing to holiday@breakersnorth.com 6.6 Third party agent bookings will have different terms and conditions. Please check with them directly prior to booking.

7. REFUNDS & TERMINATIONS BY AGENT:

7.1 Breakers North will not be held responsible should a unit no longer be available to be booked, is listed for sale, sold or the Agent’s appointment to act is terminated and your booking is cancelled. 7.2 If after arrival clients are dissatisfied with any aspect of their accommodation & decide to terminate their stay, the amount to be refunded, if any is at the sole discretion of Breakers North.

8. ARRIVALS & DEPARTURES:

8.1 Check in FROM 2.00pm. For guaranteed arrival prior to 2pm you must book the previous night at the applicable rate (subject to availability). 8.2 Check out time is strictly by 10.00am. 8.3 Upon check in you the person responsible for the booking must be present, show acceptable photo ID (passport or driver’s license) and we must sight the credit card used to make the booking, unless prior arrangements have been made with reception. 8.4 No persons under the age of 18 will be checked in without a guardian present. 8.5 Office hours are from 8.30am – 5.00pm Monday to Friday, 8.30am – 2pm Saturday and 8.30am – 12 noon on Sunday. 8.6 After hours arrivals are available by prior arrangement with the office.

9. USE OF THE PREMISES:

9.1 The apartment must be left in a similar state to the condition on arrival. Failure to leave the apartment in a satisfactory manner may result in you incurring extra charges. You authorise us to charge you for any additional costs we incur to clean the premises at our discretion upon your departure. 9.2 Upon departure the apartment should be vacated on time and secured. All food must be removed from fridges, freezers and pantry and all rubbish removed or placed in bins provided. All crockery and cutlery must be washed and packed away. All furniture and furnishings are to be returned to the position they were in upon arrival. 9.3 Only the number of people listed on your confirmation letter are included in the nightly rental rate and permitted at the premises. 9.4 The number of guests in the apartment should not exceed the number agreed to under the tariff rate at any time unless you have advised us in advance and additional bedding arrangements have been made. If there are more people than declared at the property upon check in, or any time during your stay, we reserve the right to terminate your booking without prior notice and all rental monies paid will be fortified. 9.5 Due to health and Safety and Fire Regulations guests must not sleep on couches or in any other areas apart from in beds supplied. If additional bedding is required you must order organise this through reception prior to your booking. 9.6 All apartments are strictly NON-SMOKING. A minimum cleaning/deodorising fee of $250 – 550 will apply if smoking has taken place inside the property. You are permitted to smoke on the balcony with the doors closed. 9.7 Animals are strictly prohibited. 9.8 You must comply with all reasonable directions provided by us. We reserve the right to enter the premises at any time for any reason to ensure the compliance with these Terms and Conditions. 9.9 It is the guest/s responsibility to maintain the security of the apartment once key-hand over has taken place, this includes keeping all doors/windows locked at all times to maintain security.

10. BALCONIES:

10.1 A maximum of six (6) people are allowed on a balcony at any one time. 10.2 Guests must not climb, sit on, push or use strong force against the railings. 10.3 Avoid any behaviour that may cause injury or death. 10.4 Ensure all balcony doors are locked when not in use. 10.5 Do not go out on the balcony if you are under the influence of alcohol or drugs. 10.6 Ensure that children are supervised at all times when using the balcony.

11. SWIMMING POOLS:

11.1 You and your guests must not use glass or glass products in the pool area. 11.2 Ensure that children are supervised at all times. 11.3 Children must not use swimming pools without an adult present.

12. PARKING:

12.1 Guests must only park their vehicle in the designated area.  You will be informed of the designated area upon check in.

13. PARTIES:

13.1 Parties are strictly NOT allowed in the apartments including; The definition of a party is at our sole discretion and may include any situation where the maximum number of guests allowed per premises is exceeded, the noise level is deemed too high, excessive traffic to and from the premises is identified, intoxication and or excessive alcohol is present. 13.2 If any unit is identified as having a party (at our sole discretion) we reserve the right to immediately evict all occupants and terminate your booking. Should this happen, all rental monies paid will be forfeited. In addition to this any expense resulting from cleaning, replacement of any furniture/fixture/breakage, including lost keys as well as any repairs will be deducted from the bond or charged to your credit card.

14. EVICTIONS:

14.1 Breakers Management reserve the right to immediately evict any guest, visitor or member of the public for the following (but not limited to) reasons: Intoxication and/or unsavoury/lewd behaviour; Throwing objects off any balcony, spitting or vomiting over the balconies, wilful damage to the premises, physical or verbal abuse/assault of our staff, other guests, residents, members of the public on or around the premises, behaviour deemed as a potential safety threat to others, any breach of these Terms and Conditions.

15. SMOKE ALARMS:

15.1 Accidental setting off of these smoke alarms may result in the fire brigade attending, if the fire brigade attends a false alarm this will result in a fine which will be passed onto the guest. 15.2 Do not tamper with any smoke alarm devise.

16. CLEANING & LINEN:

16.1 All apartments have linen included in the tariff unless otherwise stated (beach towels are not supplied but can be hired at an additional cost). 16.2 Apartments are fully self-contained and are not serviced daily. Should you require additional services please contact us prior to your arrival (charges will apply). 16.3 We are not responsible for any items left at the property after your departure. 16.4 Any requests for extra linen will be at the expense of the guest (1 towel per person is supplied, additional towels can be hired).

17. INFORMATION ABOUT RENTALS:

17.1 Whilst care is taken to ensure that the description of facilities and services of Breakers North Holiday Apartments is accurate, these are continually being changed, upgraded, and on occasion taken out of service. If any feature/facility is essential for the guest in choosing, it is advisable that the guest checks this with the reservation staff at time of booking. Breakers Management cannot be held liable for omissions or errors, whether temporary or permanent, in regards a property’s facilities and services. 17.2 Photographs shown are an accurate representation of the property at the time the photograph was taken and are subject to change and fair wear and tear. Neither Breakers North nor the owner of the apartment accept responsibility for personal perceptions. Furniture is changed from time to time.  All apartments are individually owned and differently furnished. 17.3 In the event of faults and/or malfunctions of appliances, facilities or inclusions, there is NO obligation from the owner or Breakers Management to compensate or discount. 17.4 All apartments are individually owned. They have kitchens with a variety of items selected by the owner (basic crockery, cutlery, glassware, pots, pans and utensils).  If you require SPECIFIC items we suggest that you bring your own.
